In this inverse condemnation action, the Municipality of Anchorage (municipality) appeals the trial courts grant of summary judgment in favor of Sandberg, Davis and Richards (SD&R). The municipality argues that the court erred in finding that its activities resulted in a taking of SD&Rs property pursuant to art. I, § 18 of the Alaska Constitution. We reverse the courts grant of summary judgment in favor of SD&R and remand the case for entry of summary judgment in favor of the municipality.
